1. Introduction

These Terms of Use ("Terms") govern access to and use of the Neighbourly Hub platform ("Platform").

By registering, accessing, or using the Platform, you agree to be bound by these Terms.

If you do not agree, you must not use the Platform.

2. Definitions

  • "Platform" – Neighbourly Hub software application
  • "Complex" – A residential community (HOA, strata, or development)
  • "Administrator" – Authorised user managing a Complex
  • "User" – Any person granted access to the Platform
  • "We" / "Us" – Neighbourly Hub

3. Eligibility & Authority

By registering a Complex, you confirm that:

  • You are authorised to act on behalf of the Complex
  • You have the authority to bind the Complex to these Terms
  • All information provided is accurate

Neighbourly Hub is not responsible for verifying such authority.

4. Scope of Service

Neighbourly Hub provides a platform to support:

  • Resident and unit management
  • Billing and payment tracking
  • Maintenance and booking workflows
  • Communication and reporting

Neighbourly Hub does not act as a financial institution, a property manager, or a legal or accounting service provider.

5. Account Responsibility

The Complex is responsible for:

  • Managing user access and permissions
  • Maintaining the confidentiality of login credentials
  • Ensuring that only authorised persons have access to the Platform

All actions taken under a user account are deemed authorised by the Complex.

6. Acceptable Use

Users agree not to:

  • Upload false or misleading data
  • Access data without authorisation
  • Interfere with system functionality
  • Use the Platform for unlawful purposes

Neighbourly Hub reserves the right to suspend access for violations.

7. Data Responsibility

The Complex is solely responsible for:

  • The accuracy of all data entered
  • Ensuring lawful collection and use of personal data
  • Managing data updates and deletions

Neighbourly Hub does not verify or validate user-provided data.

8. Data Protection

Use of the Platform is subject to our Privacy Policy and Data Processing Agreement. Neighbourly Hub acts only as a data processor.

9. Fees & Payments

Where applicable, subscription fees are payable in advance. Failure to pay may result in suspension of access.

Neighbourly Hub is not responsible for processing resident payments or resolving payment disputes.

10. Service Availability

Neighbourly Hub aims to provide reliable service but does not guarantee uninterrupted availability and may perform maintenance or updates at any time.

11. Changes to the Platform

Neighbourly Hub may modify features, add or remove functionality, and improve or update the Platform at any time. Continued use constitutes acceptance of changes.

12. Intellectual Property

All rights in the Platform remain the property of Neighbourly Hub. Users are granted a limited, non-transferable right to use the Platform.

13. Limitation of Liability

To the maximum extent permitted by law, Neighbourly Hub shall not be liable for:

  • Data inaccuracies
  • Financial losses or disputes
  • Decisions made using Platform data
  • Unauthorised access due to user negligence
  • Service interruptions

14. Indemnity

The Complex agrees to indemnify Neighbourly Hub against any claims arising from improper data use, breach of applicable laws, or misuse of the Platform.

15. Termination

Neighbourly Hub may suspend or terminate access if these Terms are breached, payment obligations are not met, or there is a risk to platform integrity.

16. Governing Law

These Terms are governed by the laws of Jamaica.

17. Updates

These Terms may be updated from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.
